Workers’ Compensation Appeals Tribunal

Vice-Chairperson

Overview:

The Workers’ Compensation Appeals Tribunal (WCAT) hears appeals relating to any decision, order or ruling of any officer of the Workplace Health, Safety and Compensation Commission (WorkSafeNB) affecting the rights of an employer, worker or a dependent under the:

  • Workplace Health, Safety and Compensation Commission and Workers’ Compensation Appeals Tribunal Act,
  • Workers’ Compensation Act,
  • Occupational Health and Safety Act, and
  • Firefighter’s Compensation Act.

The position of Vice-Chairperson of WCAT is part-time and involves chairing (usually acting alone) hearings under the various statutes within WCAT’s jurisdiction as well as the drafting of written decisions of the Tribunal.

Duties of Vice-Chairpersons:

Depending on their schedules, Vice-Chairpersons may be asked to chair one to three hearing days per month, each hearing day usually consisting of three appeals.

Potential candidates should also consider that the equivalent of one two-day educational session is held each year for members.

The WCAT provides in-house training to all new appointees.

The Department of Post-Secondary Education, Training and Labour is now accepting expressions of interest from qualified candidates for appointment as a Vice-Chairperson of WCAT.

Expressions of interest received for this position may also be used to fill future vacancies.

Qualifications:

Candidates will be judged based on consideration of following qualifications:

  • being a barrister and solicitor who is a member in good standing of the Law Society of New Brunswick;
  • having past experience sitting as a member of a board/tribunal, preferably as a hearing chairperson on a panel, with the ability to assess issues and participate in consensus decision-making;
  • having experience or education in business, economics, finance, management, accounting, insurance or administrative law;
  • having the ability to conduct all aspects of a hearing confidently; and
  • having superior analytical skills and the ability to write an objective, logical decision in light of existing law, policies, guidelines and the evidence presented.

The composition of the Tribunal’s gender and linguistic representation, as well as the cultural and geographic diversity of the province is a consideration for appointment.  

Conditions / Compensation:

Vice-Chairpersons receive a per diem of $286.20 plus expenses to cover travel. In addition, an equivalent allowance is made for preparation and drafting time.
